  • Pharmacy and rebate handling. How your PBM contract treats rebates, spread pricing, and market checks — the issues at the center of the J&J litigation.
  • Fees and vendor accountability. Whether you have written disclosure of broker compensation (CAA §202), whether fees have been benchmarked, and how broker comp is structured.
  • Committee and documentation. Whether current plan documents are accessible, whether meeting minutes exist, and whether you have a written Investment Policy Statement or equivalent.
  • Recent actions. CAA gag clause attestation status and whether you've had an independent plan review in the last 12 months.
